On the recommendation of Prime Minister Shehbaz Sharif, President Dr. Arif Alvi approved a summary on Wednesday for the submission of a reference in the Reko Diq Project before the Supreme Court of Pakistan under Article 186 of the Constitution of Pakistan, 1973.
The Apex Committee had previously approved a framework for resolution and resuscitation of the Reko Diq Project in March 2022. The Apex Committee was chaired by the minister for finance and Tethyan Copper Company Pakistan (Private) Limited shareholders.
In a meeting on September 30th, the federal cabinet authorised the submission of a referral to the Supreme Court under Article 186 of the Constitution with regard to the following legal issues of public importance.
i. Do the Reko Diq Agreements between the governments of Pakistan and Balochistan remain legitimate despite the earlier Supreme Court decision Maulvi Abdul Haque Baloch v. Federation of Pakistan PLD 2013 SC 641, the Pakistani Constitution, legislation, or public policy?”
ii. Is the proposed Foreign Investment (Protection and Promotion) Bill, 2022, legal and constitutional if it were to become law?”
