People knowledgeable on the situation told CNN that former President Donald Trump’s lawyers are engaged in a covert legal struggle to prevent a federal grand jury from inquiring of an increasing group of close Trump advisers about his attempts to rig the 2020 election.
The high-stakes legal battle, in which three Trump attorneys appeared at the federal courthouse in Washington, DC, on Thursday afternoon, is the former President’s most aggressive attempt to assert executive privilege and attorney-client privilege and stop some witnesses from testifying in the criminal investigation surrounding the events of January 6, 2021.
For Trump’s post-presidency legal problems, the court battle over privilege, which has not previously been published and is under seal, represents a turning moment.
Depending on how the case is decided, prosecutors may or may not be able to breach the wall that Trump has erected around the talks he had with his legal counsel while he was working to rig the 2020 election and in the West Wing.
According to the persons informed, this issue surfaced when former Trump White House aide and attorney Eric Herschmann was served a grand jury subpoena.
