Judiciary’s role imperative to ensure ‘Climate Justice’ amid galloping environmental degradation: Romina

ISLAMABAD: Coordinator to the Prime Minister on Climate Change, Romina Khurshid Alam on Saturday said the role of judiciary has become imperative to ensure ‘Climate Justice’ through oversight of policy decisions and interventions to address galloping impacts of environmental degradation on the country.

She was addressing as chief guest at the closing ceremony of the climate change conference titled “Navigating Climate Governance: Executive Action and Judicial Oversight” organised by the Law and Justice Commission of Pakistan here at the Supreme Court of Pakistan.

Romina Khurshid Alam said the judiciary safeguards public dignity and interests against threats to environmental justice, whereas the Supreme Court had set great precedent through landmark environmental judgements.

She added that the Ministry of Climate Change and Environmental Coordination had developed robust policy frameworks like Climate Change policy, Climate Change Act and also initiated ambitious projects like GLOF-II, Living Indus Initiative, Green Pakistan Programme and creation of National Climate Change Authority to spearhead climate action.

After the 18th amendment, she said the four provinces had established their climate change policy whereas the remaining two were to make their policy by the Supreme Court.

She added that technological advancement, innovation, coordination and collaborations among all stakeholders were critical to ensure all-inclusive climate resilience.

Ambassador of Republic of Azerbaijan, Khazar Farhadov in his special remarks extended his felicitations to the Supreme Court for successfully holding climate change conference. He said Azerbaijan was committed to host COP-29 global climate moot in Baku amid extremely evident impacts of climate change amid surging Greenhouse Gas emissions disrupting nature of balance globally.

He added that recently President designate of COP-29, Mukhtar Babayev acknowledged Pakistan’s climate action commitment, whereas Azerbaijan was elected in December 2023 unanimously by all countries that showed its credibility.

Ambassador Farhadov said Azerbaijan would mobilise international community on reducing carbon emissions and unite the entire world for collective efforts.

“Climate finance will be an important part of the negotiations at COP-29, whereas Azerbaijan has put climate action at the heart of its policies and interventions. Azerbaijan is the leading country of the region in renewable energy transition,” he said.

Earlier, during the panel discussion titled “Court-ing Climate Change”, Ahmed Rafay Alam, Environmental Lawyer and Climate Activist said the earth’s delicate ecological balance that enabled human species to implement activities like agriculture to support prevailing civilization was at risk.

He added that the previous year was the hottest evert since the past 2000 years that eroded the delicate balance between nature and human civilization which was over.

“Asian heatwave 2024 has decimated crops in Sindh, whereas the wettest month of 2024, April caused over hundred deaths, whereas pneumonia killed hundreds of children in Punjab,” he said.

He pointed out that existing environmental law only dealt with industrial pollution and did not address biodiversity in totality, whereas the legal system needed to adapt with the changing world.

Director Federal Judicial Academy, Muhammad Amir Munir said Pakistan has 133 constitutional Court judges whereas members of district judiciary were 3200 whose verdicts remained less publicized.

He urged the members of judiciary to consider not only legal but also environmental perspective in line with the UN, international laws and treaties with human rights and security at its core.

Judge Lahore High Court, Justice Jawad Hassan said the Supreme Court had passed remarkable judgements that made Pakistan a better country by the rest of the world.

He commented that climate justice was for adaptation, whereas the court’s role should be oversighted to ensure that the funds intended to address climate resilience initiatives were spent accordingly.

“Judiciary in Pakistan protects investments and it’s a green judiciary. However, with the arrival climate finance pouring into Pakistan, there will be a floodgate of cases in Pakistan,” Amir Munir said.

Judge Supreme Court of Pakistan, Justice Ayesha A. Malik said there was an increase in the cases of climate change litigation, adding, “There is no direct or ready formula to connect climate change with human rights but there is something that has to be crafted and brought into the system. Judges can’t resolve climate change but rather identify rights and duties and state action which is necessary.”

She added that the courts could encourage the government and relevant departments to mull over climate change impacts and devise policies accordingly for a resilient society and better climate governance.

“Women are the most impacted during climate crisis, whereas community participation is important that gives government insight to the issue and the court can enhance government insight and humanize the issue for propitious and well-coordinated actions,” she said.

Justice Ayesha Malik the courts have developed public private partnerships through judgements for infrastructure development, whereas the court directs government to submit regular reports to monitor and ensure compliance that would create data, required information, ongoing monitoring, addressing delays, transparency and accountability in the system.

“The judiciary has to adopt innovative and creative approach towards climate change cases, think about planet and coming generations read and update yourselves to think climate, rights and create solutions,” she said.

Senior Puisne Judge, Supreme Court, Justice Syed Mansoor Ali Shah said all judges needed to consider and uphold human rights during climate cases and would have to develop biocentric approach to restore nature instead human-centric approach.

“When you protect nature’s dignity you automatically protect human dignity. However, the Apex Court is thinking over incorporating green alternate dispute resolutions (ADRs) in our approach, whereas commercial courts would be the best venue for addressing climate change cases at district level,” he said.

Justice Shah underlined that the nation would have to bring change in its lifestyle amid changing climate, whereas the apex court should also consider low carbon footprint and efficient energy consumption prospects to conserve environment.

The two sides strongly condemned the terrorist attack on the Chinese convoy of the Dasu Hydropower Project in Pakistan on March 26, 2024, and emphasized that no attempt to undermine Pakistan-China friendship and cooperation will ever succeed. The Chinese side appreciated the Pakistani side’s active pursuit and conduct of the investigation and its findings, and hoped that the Pakistani side would continue to make every effort to hunt down any perpetrators and make sure they receive deserved severe punishment. The Pakistani side was committed to enhancing security forces deployment and taking more effective security measures, and making all-out efforts to ensure the safety of Chinese personnel, projects and institutions in Pakistan.

The two sides reiterated their commitment to combating terrorism in all its forms and manifestations with a “zero tolerance” attitude, and agreed to further strengthen cooperation in counter-terrorism and security through a comprehensive approach. Calling on the international community to strengthen counter-terrorism cooperation, the two sides expressed their firm opposition to double standards on counter-terrorism, and opposed the politicization and instrumentalization of counter-terrorism. The two sides stood ready to work with the international community to strengthen multilateral counter-terrorism cooperation within multilateral frameworks such as the United Nations.

The two sides recognized that the China-Pakistan Economic Corridor (CPEC) has been a pioneering project of the Belt and Road Initiative. Since the launch of CPEC, the two sides have adhered to the principle of “planning together, building together, and benefiting together,” and promoted the construction of CPEC to achieve fruitful results, which has changed the development landscape of Pakistan, benefited its people’s well-being, and promoted the integrated development of Pakistan and China. After the successful first decade of CPEC, the two sides are committed to carrying out the eight major steps for supporting high-quality Belt and Road cooperation, forging an “upgraded version” of CPEC by jointly building a growth corridor, a livelihood-enhancing corridor, an innovation corridor, a green corridor and an open corridor, aligning with Pakistan’s 5Es Framework based on Exports, E-Pakistan, Environment, Energy, and Equity & Empowerment to better benefit the two countries and their peoples, working together to build CPEC into an exemplary project of high-quality building of Belt and Road cooperation.

Expressing satisfaction at the holding of the 13th CPEC’s Joint Coordination Committee (JCC) meeting (online) on May 24, 2024, the two sides agreed to expeditiously implement consensus achieved by the JCC.

The two sides reaffirmed that upgradation of ML-I is an important project under the CPEC framework and is of strategic significance to Pakistan’s socio-economic development. The two sides agreed to implement the common understanding of the leaders of the two countries, actively explore advancing the project in a “phased manner” and start working on financing modalities.

 
The two sides recognized that the Karakoram Highway (Raikot-Thakot) realignment project is of great significance for the smooth operation of the only land-based channel between Pakistan and China. The two sides reviewed with satisfaction the important progress made in the preliminary work of the project, and signed the framework agreement of the project during this visit.

The two sides believed that the Khunjerab-Sost pass plays an important role in promoting trade and people-to-people exchanges between Pakistan and China. The two sides agreed to advance upgradation of the inspection infrastructure of the Khunjerab-Sost pass so as to realize the all year-round function of the Khunjerab-Sost pass at an early date.

Recognizing the significance of Gwadar Port as an important node in cross-regional connectivity, the two sides were satisfied that the New Gwadar International Airport will soon be finished, and reiterated the need to speed up the development of the auxiliary infrastructure of the Gwadar Port in order to fully realize the potential of the coastal city, especially as a transshipment hub with a shipyard.

The two sides put great emphasis on industry cooperation under the framework of high-quality CPEC development. The two sides signed the Action Plan for Framework Agreement on Industrial Cooperation under CPEC to strengthen industrial cooperation in various areas suited to their local conditions. China reiterated its commitment to Pakistan’s industrialization, and will encourage Chinese companies to invest in Pakistan’s Special Economic Zones in accordance with the market and commercial principles. Pakistan agreed to optimize its business environment and policy framework to further facilitate Chinese investment. The two sides reiterated that CPEC is an open and inclusive platform for win-win cooperation, and welcomed third parties to actively participate in the CPEC cooperation priority areas such as industry, agriculture, ICT, science and technology and mining.

Recognizing that mining is an important breakthrough area for industrial cooperation, both sides agreed to strengthen long-term planning for mining cooperation, promote the implementation of the Agreement to Strengthen Mining and Industrial Cooperation under the CPEC Framework collectively, and take actions such as geological survey, joint geology and minerals research and talent training. The two sides expressed their willingness to actively encourage Chinese companies to invest in the mining industry of Pakistan, and strengthen the planning of mining industrial parks, including downstream mineral processing.

The Chinese side expressed its willingness to strengthen cooperation with Pakistan in such areas as offshore oil and gas resources, and natural gas hydrate. The Chinese side would encourage Chinese companies to actively participate in the development of offshore oil and gas blocks of Pakistan.

Both sides agreed that agricultural cooperation between the two countries enjoys a bright future. The two sides would carry out practical cooperation for modernizing agriculture in Pakistan in areas such as seed technology, crop cultivation, drip irrigation, prevention and control of animal and plant diseases, agricultural mechanization, production capacity cooperation, and agricultural technology exchanges.

Both sides were satisfied with the outcomes reached in the second meeting under the framework of the CPEC Joint Working Group on Information Technology Industry. The two sides are willing to enhance policy coordination in related areas, and promote experience sharing and talent training. The two sides agreed to strengthen development of the Pakistan-China digital information channel, and promote the integration of information and communication technology infrastructure and develop an innovation corridor through Pakistan.

The two sides were satisfied with the progress in energy cooperation between Pakistan and China. The two sides reaffirmed the significance of enhancing bilateral energy cooperation, expressed commitment to further strengthening collaboration in clean energy sector, and encouraged Chinese companies to engage in hydropower and other relevant projects based on market principles and commercial operations and achieve win-win outcomes. While appreciating China’s contributions to addressing power shortages in Pakistan, both sides agreed to launch a new phase of energy cooperation, by modernizing production, transmission and distribution systems to reduce line and other losses.

China was committed to further implementing more “small yet smart” livelihood programs in Pakistan. The two sides agreed to promptly implement post-disaster reconstruction aid projects aided by China in Pakistan at an early date. The two sides welcomed CIDCA’s enhanced contributions to complementing the efforts of the Government of Pakistan in promoting socio-economic development and creating further livelihood opportunities for the people of Pakistan as envisaged under Global Development Initiative (GDI).

Under the framework of the Phase II of Pakistan-China Free Trade Agreement, both sides agree to conduct further consultation and actively explore concessional arrangements for mutual benefit and win-win outcomes.

The two sides agreed to further strengthen bilateral cooperation in the financial sector and stand ready to support each other in regional and international multilateral financial forums.

The leaders expressed satisfaction on the completion of the report of Pakistan’s Industrial Landscape and Suggestion to Improve its Export Capacity, and expected the report, as reference would contribute to Pakistan’s industrial and export capacity.

The Pakistani government identified 13 priority sectors for enhancing export oriented industry and encouraged Chinese top companies in these sectors to make investment in Pakistan. The Chinese side welcomed Pakistan to expand exports to China.

Climate conference: CJP Isa suggests providing bicycles to judges

ISLAMABAD: Addressing a climate change conference hosted by the Supreme Court, Chief Justice of Pakistan (CJP) Qazi Faez Isa called for adopting eco-friendly measures and a healthy lifestyle to cope with the prevailing climate-related challenges.

The top court organised the conference titled: “Navigating Climate Governance: Executive Action and Judicial Oversight” on Saturday which was addressed by honourable top jurists, environmental experts, government high-ups and other notable speakers.

“Whenever we consult doctors, they advise us to leave smoking and do walk. A rise in the human body’s temperature indicates our illness but today, earth is also facing ailment like a fever as it is absorbing a lot of smoke into it,” said the top judge.

CJP Isa pointed out that plastic products were being manufactured across the world but we lacked a solid mechanism to dispose of them.

He also urged returning to a healthy lifestyle which is closer to nature. “Every physician is now advising to eat vegetables instead of meat.”

“[Justice] Mansoor Ali Shah talked about hybrid vehicles here but we need to walk. Bicycles can be provided to all judges if they want,” suggested CJP Isa.

He added that human beings were facing severe consequences for neglecting the common practices today like conserving electricity and food which led to a shortage of natural resources.

“We failed to know nature and we need to rebuild the values for environmental protection from our homes. The natural environment can be saved from further destruction by avoiding wastage of resources,” said CJP Isa.

Pakistan has been facing severe impacts of climate change like devastating floods, flash droughts, scarcity of water resources and excessive heat despite the country’s total contribution to the global emissions being less than 1%.

Earlier this month, the National Drought Monitoring Centre (NDMC) of the Pakistan Meteorological Department (PMD) said in an advisory that a flash drought-like situation is predicted in the heatwave-impacted regions across the country.

The NDMC said that flash drought, triggered by heatwaves, may result in rainfall shortage in the country this year.

“Keeping in view the climatology and current forecast for June, drought conditions may exacerbate and affect the agriculture, water resources and live stocks, before the arrival of the summer monsoon,” the advisory mentioned.

It added that flash droughts can have a significant impact on agriculture, water resources, and ecosystems, and can also lead to crop failure, wildfires, and water shortages.

The NDMC advised all stakeholders to take pre-emptive measures for disaster-prone districts.
